THE PROCEDURE FOR CARRYING OUT CASH TRANSACTIONS WITH CUSTOMERS AND CLIENTS IN UKRAINE:

WHAT IS NECESSARY TO KNOW

As everyone knows two forms of payments exist – cash and non-cash. Cash payment is widespread among the population. The majority of Ukrainians used to trust cash more than abstract figures on bank accounts, because cash is tangible while non-cash, though it belongs to a certain-person, is nonetheless still in a bank's "pocket.'

When talking about cash payments, even a boy who buys his favourite ice-cream in a shop pays attention to the fact that the cashier who takes his money gives him a slip from a "wonder-machine" (i.e. from an electronic cash register - one of the payment transaction registers (hereafter PTR)).

A number of normative acts were adopted to exercise control over cash circulation. The principal one is the Law of Ukraine: 'On Amendments to the law of Ukraine' 'On Using Electronic Cash Registers and Stock-cash Books While Making Payments with Customers in the Spheres of Trade, Food Services and Service Organizations' No 1776-111 which came into effect on 1 January 2001 (hereafter Law on PTR).

Thus, on selling goods, rendering services for cash and/or non-cash (payment cards, payment cheques, tokens, etc.) business entities are to carry out payment transactions using duly registered PTR (Art. 3 of the Law on PTR). Such operations are to be accompanied by printing and issuing relevant payment documents (a receipt) verifying the transaction. It should be mentioned that the payment document might be of another form as well, for example, a register slip, payment receipt, or travel document.

There may arise the question, 'And what if a seller gets cash for a transaction without using PTR?' For such actions financial sanctions, determined in chapter 5 of the Law on PTR. arc-stipulated by the legislation. Thus, in the case of carrying out payment transactions without using PTR the fine is to be equal to fivefold the cost of the sold goods. And if you use unregistered PTR, the sanctions are to be 20 tax-free minimum individuals' incomes, i.e. currently 20 x 17 UAH=340 UAH.

As earlier stated, the Law on PTR is the principal document. But, undoubtedly, there exist other normative acts adopted to meet the requirements of the above-mentioned Law. It is evident that each rule has its exceptions and Article 3 of the Law on PTR is no different. It defines the conditions when payment transaction registers may not be used while performing cash transactions. Here are some of them:

1. The sale of goods produced by the seller. For this purpose it is necessary to make payments at an enterprise's cash desk which issues credit/debit cash slips. However, this privilege does not apply to commercial enterprises, food services and service organizations.

2. The sale of goods (except excisable ones) and services by business entities - individuals whose income taxation is carried out in the following way:

- according to the fixed tax amount via purchasing a patent in compliance with Decree No. 13-92 of the Cabinet of Ministers of Ukraine 'On Individuals’ income Tax' of 26 December 1992:

- in compliance with Decree No.727/98 of the President of Ukraine 'On Simplified Taxation System, Accounting and Reporting of Small Business Entities' of 3 July 1998.

3. The sale of foodstuffs and manufactured goods in the market by individuals on the assumption that they pay. a market fee in compliance with Decree No.56-93 of the Cabinet of Ministers of Ukraine 'On Local Taxes and Fees' of 20 May 1993.
